1. Acceptance of the terms

These terms and conditions (the "Terms") govern your use of the phptravels.com website, the PHPTRAVELS software and every related service. By accessing or using any of them you agree to be bound by these Terms. If you do not agree, please do not use our services.

We may update these Terms from time to time. The date at the top of this page tells you when they last changed. Continuing to use our services after a change is posted means you accept the new Terms.

2. Our services

PHPTRAVELS provides travel booking software and the services around it, including:

• A complete travel booking platform with flights, hotels, tours, cars, transfers, visas and other modules, with B2C and B2B booking portals.
• Mobile applications for iOS and Android.
• The administration dashboard and management tools.
• API integrations with third-party travel suppliers and payment gateways.
• Installation, technical support, updates and maintenance, according to the plan you purchased.

3. Software licence

When you buy PHPTRAVELS you receive a limited, non-exclusive, non-transferable licence to use the software for your own business, on the number of domains and installations your plan allows. The source code is delivered to you so that you can customise and modify it to meet your own requirements.

You may not resell, redistribute, sublicense, share or publish the source code, in whole or in part, without our explicit written permission. The licence covers the version you purchased and includes the updates your plan entitles you to; major version upgrades may require an additional fee.

A breach of the licence terms may lead to immediate termination of your licence and account and to legal action.

4. Accounts and responsibilities

You are responsible for keeping your account credentials confidential and for every activity that takes place under your account. You must give us accurate and complete information when you create an account and keep it up to date.

You must be at least 18 years old, or use our services under the supervision of a parent or guardian. Unacceptable or abusive use of our services, our staff or our systems is governed by our abuse policy, which forms part of these Terms.

5. Privacy and data protection

Your privacy matters to us. We collect and process personal data in accordance with the applicable privacy laws and with our privacy policy, which explains what we collect, why, and the rights you have over it, including access, correction and deletion. We apply appropriate security measures to protect your personal information.

When you run PHPTRAVELS for your own customers, you are responsible for the personal data of your travellers and for complying with the laws that apply to your business.

6. Intellectual property

All content, software, designs, documentation and other materials we provide are protected by international copyright and intellectual property laws. PHPTRAVELS owns all intellectual property rights in the platform and the services. Your licence does not transfer these rights to you.

You may not copy, modify, distribute or publish our materials beyond what your licence allows. We respect the intellectual property of others and expect our customers to do the same; any unauthorised use of our intellectual property may result in legal action.

7. Payments and pricing

Prices are shown clearly during the purchase process and include the applicable fees. Payment is due in full when you place an order and is processed securely through encrypted, PCI-compliant payment gateways. We accept the major cards and the other payment methods shown at checkout.

Prices may change without notice. A change never affects an order you have already placed.

8. Refunds and cancellations

Because the full source code is delivered to you, we generally do not issue refunds once the product has been delivered. In exceptional circumstances a refund may be granted:

• Non-delivery caused by a technical problem on our side, reported within 7 days of purchase.
• Download or installation problems that our support team cannot resolve, reported within 3 days.
• A major defect in the software that we cannot fix, reported within 7 days.
• A product that is clearly not as described, with evidence provided within 7 days.

Refund requests must be made in writing with the relevant documentation. Services that have already been performed, such as installation or custom work, are not refundable.

9. Technical support

We provide technical support for installation, configuration and troubleshooting of the software through our ticketing system, email and the other channels shown on the Site. Response times depend on the complexity of the issue and on your support plan.

To diagnose and resolve a problem we may ask for temporary access to your server. Support does not include custom development, third-party software or hosting issues outside our control.

10. Limitation of liability

Our services are provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the services will be uninterrupted or error-free.

To the fullest extent permitted by law, PHPTRAVELS is not liable for any indirect, incidental, special or consequential damages, including loss of profit, revenue or data. Our total liability for any claim is limited to the amount you paid us for the service concerned. You are responsible for backing up your data and for the security of your own installation.

11. Termination

Either party may end this agreement with reasonable notice. We may suspend or terminate your account or licence if you breach these Terms. When the agreement ends, your right to use our services ceases immediately; the provisions that by their nature should survive, such as intellectual property, liability and governing law, continue to apply. You remain liable for any outstanding payments and for any breach that occurred before termination.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute that we cannot settle amicably will be resolved by binding, confidential arbitration, and you consent to the jurisdiction of the courts of California for the matters that cannot be arbitrated. We may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property.
