DMCA and content protection policy

Everything on phptravels.com, from the articles and guides to the design, the screenshots and the software itself, is created by PHPTRAVELS and protected by copyright and trademark law. This policy explains what we protect, how we act on copies, how to report one, and how to send us a DMCA notice.

Scope

This policy covers phptravels.com in every language, our blog, our documentation and the PHPTRAVELS software. It explains how we protect our work, how anyone can report a copy of it, and how to contact us if you believe something on our site infringes your own copyright. It forms part of our terms and conditions.

What we own

Unless a page says otherwise, PHPTRAVELS owns the copyright in:

  • The text of every page, article, guide, FAQ and translation on this site.
  • The design, layout, illustrations, interface mock-ups, screenshots, photos and videos we created.
  • Our documentation, release notes and training material.
  • The PHPTRAVELS software and its source code, which customers license from us; they do not buy the copyright.

You are welcome to link to any page and to quote a short passage with a link back to the original. Copying a page, an article or the design in full or in large part, translating it, or republishing it on another site needs our written permission.

Our name and logo

PHPTRAVELS and the PHPTRAVELS logo are trademarks of PHPTRAVELS. They may not be used without our written permission:

  • In a domain name, a company or product name, an app name or a social media account.
  • In advertising, search keywords or page titles that suggest a connection with us.
  • To sell, give away or promote a "clone", "nulled" or otherwise unofficial copy of our software.

The official PHPTRAVELS software is sold only at phptravels.com. Writing honestly about PHPTRAVELS, such as a review or a comparison, is fine as long as it does not suggest that you are us or that we endorse you.

How we protect our work

We monitor the web for copies of our pages, misuse of our name and unofficial copies of our software. When we find one, we act through the channels the law provides:

  • DMCA notices to search engines, which remove the copies from search results.
  • Notices to the hosting provider, which can remove the pages entirely.
  • Complaints to the domain registrar and, where a domain uses our trademark, domain dispute proceedings that can transfer the domain to us.
  • Legal action where the copying continues.

We keep dated records of our original publications, so the first publisher can always be shown.

Report a copy of our content or brand

If you find our content, our design, our name or a copy of our software on another site, please tell us. It helps us, and it protects travel agencies from buying unofficial copies. Send us:

  • The address (URL) of the page with the copy.
  • The address of our original page, if you know it.
  • A screenshot, if you can.

Email info@phptravels.com with the subject "Copyright report", or use the contact page. We read every report.

Send us a DMCA notice

We respect the rights of others. If you believe that material on phptravels.com infringes your copyright, send a written notice to info@phptravels.com that includes, as the US Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)) requires:

  • Your physical or electronic signature.
  • A description of the copyrighted work you believe is infringed.
  • The address (URL) of the material on our site that you believe infringes it.
  • Your name, postal address, telephone number and email address.
  • A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner's behalf.

We will review a complete notice promptly and remove or disable access to the material when the notice is valid.

Counter-notice

If material you published through our services was removed after a notice and you believe that was a mistake, you can send a counter-notice to info@phptravels.com that includes:

  • Your physical or electronic signature.
  • A description of the material that was removed and where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  • Your name, address and telephone number, and a statement that you consent to the jurisdiction of the courts for your address and will accept service of process from the person who sent the notice.

We forward a valid counter-notice to the person who sent the original notice.

False notices

A notice or counter-notice is a legal statement. Anyone who knowingly misrepresents that material infringes, or that it was removed by mistake, may be liable for damages, including costs and legal fees. If you are not sure whether a use infringes your rights, please take legal advice before sending a notice.

Licensed customers

A PHPTRAVELS licence lets you use, configure and customise the software for your own business, on the domain the licence is issued for. It does not let you resell, redistribute or publish our source code, offer it as a "clone" or "nulled" script, or use our name for another product. Doing so breaches the licence and our copyright. We may then end the licence, stop updates and support, and take legal action. Customers who repeatedly infringe the rights of others through our services may also lose access to them.
